Refund and Return Policy

1. Return/Refund Application

Subject to the terms and conditions of this Refund and Return Policy and the Terms of Service, the Buyer may request the return of purchased goods ("Goods") and/or a refund before the expiration of the hubbiz warranty period specified in the Terms.

hubbiz guarantee is a service provided by hubbiz at the request of users, aiming to assist users in dealing with certain conflicts that may arise during transactions. Users may communicate privately with each other to resolve differences before, during or after using hubbiz Guarantee, or contact the relevant local authorities to assist in resolving any disputes.

2. Return application

The buyer can only apply for a refund and/or return under the following circumstances:

● The buyer has not received the item yet;

● Goods are defective and/or damaged upon delivery;

● The goods delivered by the seller to the buyer do not conform to the agreed specifications (such as errors in size, color, etc.);

● The items delivered to Buyer differ materially from the description provided by Seller in the item listing;

● By entering into a private agreement with the seller, the seller must send a confirmation letter to hubbiz to confirm the agreement.

Buyer applications must be submitted via the hubbiz mobile app.

Ten (10) calendar days after a return request is made.

If the Buyer has initiated legal proceedings against the Seller, the Buyer may provide hubbiz with a formal notice from the relevant authorities requiring hubbiz to continue to hold the purchase funds until a formal decision is made. hubbiz will determine at its sole discretion whether it is necessary to continue to hold such purchase funds.

3. Right of priority seller

If you are a Preferred Seller, you should have received separate written notification from hubbiz of your election to participate in the hubbiz Preferred Seller Program. If you decide at any time not to participate in the hubbiz Preferred Seller Program, please notify hubbiz in writing; otherwise, you will be deemed to have elected to continue participating in the hubbiz Preferred Seller Program and to have agreed to the terms and conditions set forth in this Refund and Return Policy. hubbiz may suspend or remove any Preferred Seller from the hubbiz Preferred Seller Program at any time at its sole discretion.

hubbiz’s decision to approve a refund or return in accordance with clause 2 above shall be binding on the relevant Preferred Seller. Preferred Seller agrees to comply with and take all necessary steps to effectuate a buyer's refund or return request approved by hubbiz.

For any refund or return request approved by hubbiz, hubbiz will notify the Preferred Seller by email ("Email Notification") and organize the shipping of the relevant returned items to the address provided by the relevant Preferred Seller in writing to hubbiz to complete the return. payment and return procedures, as long as the address is located in the country listed on the Site for sale of the relevant products (the "Local Address"). If the Preferred Seller fails to provide a local address for a returned item, or fails to accept delivery of a returned item within a reasonable time (as determined by hubbiz), hubbiz reserves the right to dispose of the item in any manner it deems appropriate and the Preferred Seller shall be deemed To waive all rights to the merchandise. If a Returned Item is not received by the Preferred Seller, the Preferred Seller must notify hubbiz within seven (7) days of receipt of the email notification (the "Notification Period"). Failure to notify hubbiz within the notification period will constitute conclusive evidence and result in the Preferred Seller accepting that the Goods have been delivered and the Preferred Seller agrees not to make any claim or bring any dispute in respect of any such Goods.

Notwithstanding the foregoing, items approved for refund or return may not be returned to the Preferred Seller at the sole discretion of hubbiz, and the Preferred Seller shall be deemed to have waived all rights to the item.

For any refund or return rejected by hubbiz where the relevant item has been received by hubbiz, hubbiz will organize shipping of the item to the relevant buyer's address in accordance with clause 2 above.

If hubbiz approves any refund or return request, the Preferred Seller may appeal the decision by contacting hubbiz and providing evidence to support such appeal. If hubbiz upholds the Preferred Seller's appeal, it will pay all or part of the purchase price to the Preferred Seller. The Preferred Seller acknowledges and agrees that hubbiz’s decision is final, conclusive and binding and undertakes and agrees not to litigate or otherwise assert any claim against hubbiz or its affiliates with respect to such decision.

4. Rights of ordinary sellers

For the purposes of this refund and return policy, a regular seller is a seller who is not a marketplace seller or preferred seller.

hubbiz will notify the Seller in writing when hubbiz receives the buyer's request for return of items and/or refund. Seller may respond to Buyer's application by following the steps provided by hubbiz in written notice. Seller must respond within the period specified in the written notice (the "Prescribed Period"). If hubbiz does not receive a response from the Seller within the stipulated period, hubbiz will assume that the Seller has not responded to the Buyer's application and will continue to evaluate the Buyer's application without further notification to the Seller. hubbiz will review each Seller's response on a case-by-case basis and will determine, in its sole discretion, whether the Buyer's application will be successful based on the circumstances described by the Seller.

5. Return conditions

In order to enjoy a hassle-free experience when returning goods, the buyer should ensure that the item (including any free items such as accessories that come with the item) must be returned to the seller in the same condition as received by the buyer at the time of delivery. We will advise buyers to take photos when receiving the item.

6. Responsibility for product forward freight and return freight

● In the event of an unforeseen error by the Seller (i.e. damaged, defective or incorrect product delivered to the Buyer), the Seller will be responsible for the Buyer's forward and return shipping charges.

● If the buyer changes his mind, please obtain the seller's consent before returning the product and bear the return shipping costs.

● When a buyer and seller have a dispute about the party responsible for forward freight and return freight, hubbiz will determine the responsible party for forward freight and return freight at its own discretion.

For the avoidance of doubt, if in any of the above circumstances, the Seller is responsible for the Buyer's forward shipping charges and return shipping charges, the Seller shall be responsible for the Buyer's forward shipping charges even if the Buyer uses a free shipping coupon. 7. Refund

The buyer will only receive a refund after hubbiz receives confirmation from the seller that the returned item has been received by the seller. If hubbiz does not receive a response from the seller within the specified time, hubbiz will be entitled to refund the corresponding amount to the buyer without further notification to the seller. 8. Communication between buyers and sellers

hubbiz encourages users to communicate with each other if problems arise during transactions. Since hubbiz is a platform for users to conduct transactions, buyers should contact the seller directly to resolve any issues related to the items purchased.
